TERMS OF SERVICE & SUPPLY POLICY

1. Professional Medical Supply Framework

Instavape Australia operates as a specialized Medical Supply Store and TGA Sponsor. We provide a restricted B2B gateway for the procurement of TGA-Notified medicinal cannabis hardware.

  • Access Restriction: Access to this Medical Supply Store is strictly limited to AHPRA-registered pharmacists and authorised medical entities.

  • Regulatory Authority: All hardware is supplied under the Therapeutic Goods Act 1989 and relevant Regulation 5A import protocols.

2. Intellectual Property & Protected Technologies

2.1 Trademark Protection

INSTAVAPE AUSTRALIA™ is a registered trademark. Any unauthorised use of our brand identity, logos, or medical supply nomenclature is strictly prohibited.

2.2 Proprietary Infrastructure

The Instavape Australia Pharmacy Dashboard and its underlying digital infrastructure—including custom Shopify Liquidarchitecture and proprietary API integrations—are the protected intellectual property of Instavape Australia.

  • Data Integrity: "Scraping" or unauthorized extraction of technical dossiers, pricing, or device specifications is a breach of these terms and will result in immediate account termination.

3. Medical Supply Compliance

3.1 Hardware Classification

Devices supplied by this store are TGA-Notified Medical Devices. While classified as "unapproved" (non-ARTG), Instavape Australia, as the Sponsor, has certified each device against the Essential Principles (EPs) for safety and performance.

3.2 Pharmacist Responsibility

The clinical suitability and dispensing of therapeutic goods remain the exclusive professional responsibility of the Pharmacist at hand. Instavape Australia provides the technical infrastructure and hardware; we do not provide clinical advice.


WARRANTY & REFUND POLICY (Medical Hardware)

4. Resolution Protocol: Credit or Repair

As a Medical Supply Store, we maintain a strict "Credit or Repair" policy to ensure that medical hardware remains within a controlled supply chain.

4.1 Eligible Hardware Claims

Claims may only be initiated by the registered Pharmacist for:

  • Manufacturing Faults: Hardware that fails to meet the manufacturer’s technical specifications.

  • DOA (Dead on Arrival): Functional failure identified upon the Pharmacist's initial inspection.

  • Supply Errors: Discrepancies between the medical supply invoice and the physical stock received.

4.2 Non-Returnable Items

To maintain hygiene and TGA compliance, we cannot accept returns for:

  • Change of Mind: We do not offer returns for overstocked items.

  • Opened Medical Packaging: Any device where the medical-grade seal has been tampered with or broken.

  • Improper Use: Damage caused by third-party accessories or failure to follow the technical dossier.

5. Claim Management

  1. Verification: The Pharmacist at hand must provide video or photographic evidence of the hardware fault to sales@instavape.com.au.

  2. Authorisation: A Return Authorisation Number (RAN) must be issued before any hardware is returned to our medical supply hub.

  3. Outcome: Valid claims will be resolved via Repair of the unit or a Store Credit applied to the pharmacy's account. Cash refunds are only issued if a credit or repair is unavailable.

6. Consumer (Patient) Warranty

Instavape Australia is a B2B Medical Supply Store and does not interact with patients.

  • Pharmacy Frontline: Pharmacists are responsible for managing the consumer’s rights under Australian Consumer Law (ACL).

  • Technical Support: Once a Pharmacist has verified a hardware fault, they may coordinate with Instavape Australia for a sponsor-level resolution (Credit or Repair).

7. Governing Law

These terms are governed by the laws of Australia and the state of Queensland, where our primary medical supply infrastructure is located.
