1. General Information & Scope

Welcome to Instavape Australia. By accessing or using our website (Instavape.com.au) and the associated Wholesale Dashboard (the "Site"), you agree to comply with and be bound by these Terms of Service.

Instavape Australia supplies medicinal cannabis vaporisers and hardware exclusively to registered pharmacies and authorised medical suppliers in Australia. Our products are regulated medical devices and may only be supplied in compliance with federal and state laws.

2. Trademarks & Intellectual Property

2.1 Registered Trademarks

INSTAVAPE AUSTRALIA™ is a protected trademark. Any unauthorised use of our name, branding, or logos in connection with the sale of medical hardware or vaporisers is strictly prohibited.

2.2 Protected Technologies

The Site and Dashboard utilize proprietary digital infrastructure developed by Instavape Australia. This includes, but is not limited to:

  • Custom Shopify Liquid configurations and backend architecture.

  • Proprietary API integrations and secure wholesale ordering workflows.

  • The unique layout and functional design of the Pharmacy Dashboard.

2.3 Copyright & Content Ownership

All content—including text, technical specifications, images, product descriptions, instructional media, and metadata—is the exclusive property of INSTAVAPE AUSTRALIA and is protected under Australian and International copyright laws.

  • Prohibited Acts: You may not reproduce, modify, distribute, or "scrape" any content or code from this Site without prior written permission.

  • Enforcement: Unauthorised use of our intellectual property will result in immediate account termination and potential legal action.

3. Regulatory Compliance & TGA Regulations

3.1 Therapeutic Goods Act 1989

Products on this Site are classified as unapproved medical devices under the Therapeutic Goods Act 1989. Pharmacies must strictly adhere to the TGA Special Access Scheme (SAS-B) and Authorised Prescriber (AP) pathways before dispensing to patients.

3.2 Pharmacy Responsibility

By maintaining an account or purchasing from Instavape Australia, the Buyer warrants that:

  • They are a Registered Australian Pharmacy or an authorised medical supplier.

  • They will not dispense medical devices without verifying a valid AP approval or SAS-B approval.

  • They assume full legal responsibility for compliance with all federal and state laws regarding the storage and dispensing of medical devices.

3.3 Product Standards

All medical hardware supplied by Instavape Australia meets mandatory safety and quality standards, including ISO 13485 (Medical Device Quality Management) and IEC 62133 (Battery & Electrical Safety Standards).

4. Access & Restrictions

4.1 No Direct Consumer Sales

Our products are not available for public sale. Access to the Site and wholesale pricing is strictly restricted to verified pharmacy accounts.

4.2 Account Verification

To access the Dashboard, the Buyer must:

  • Register with a valid Pharmacy ABN.

  • Submit current proof of pharmacy licensing.

  • Maintain the confidentiality of their login credentials.

4.3 Refusal of Service

Instavape Australia reserves the right to refuse service or terminate accounts that fail to comply with TGA regulations or demonstrate a breach of these Terms.

5. Liability & Indemnity

5.1 Limitation of Liability

Instavape Australia is a wholesale supplier only. We are not liable for any Pharmacy’s failure to comply with TGA or state-specific professional regulations. The Buyer assumes all responsibility for the clinical application and dispensing of the products.

5.2 Indemnification

The Buyer agrees to indemnify and hold harmless INSTAVAPE AUSTRALIA against any claims, penalties, or legal actions arising from the Buyer’s misuse of the Site, non-compliance with the Therapeutic Goods Act, or regulatory breaches.

6. Governing Law

These Terms are governed by the laws of Australia and the relevant State or Territory where the Pharmacy operates.
